Penalties for a Wyoming Domestic Violence Conviction

Under Wyoming domestic violence laws, a person who commits an assault or battery against a member of the same household may be subject to stiffer penalties and a possible felony charge.

The penalties are even higher if you prior convictions for violent crimes against a household member.

Assault Against a Household Member Can Lead to a Charge of Wyoming Domestic Violence

For purposes of the Wyoming domestic violence statute, a household member includes:

  • A current or former spouse of the accused
  • An adult with whom the alleged offender resides or previously resided
  • A parent or adult child of the alleged offender
  • A person with whom the alleged offender has a child
  • A person whom the alleged offender is dating or has previously dated

Wyoming domestic violence charges are used to enhance a charge of assault and battery. If the injuries sustained by the victim are more serious than minor scrapes and bruises, the offender will be charged with domestic violence under Wyoming’s aggravated assault statute, which is a felony punishable by between one and twenty years in prison.

Penalties for a Wyoming Domestic Violence Conviction

If the offender committed a simple assault and battery against a household member, the penalties are the same as for an assault and battery against a non-household member:

  • A conviction for simple assault is a misdemeanor, punishable by a fine of up to $75
  • A conviction for simple battery can result in a fine of up to $750 and up to 6 months in prison

If the alleged offender has prior convictions for assault and battery, aggravated assault, child abuse, or reckless endangerment of a household member within the last 5 years the penalties are:

  • For simple assault against a household member - up to 6 months in prison, a fine of up to $750, or both
  • For simple battery against a household member - up to 1 year in prison, a fine of up to $1,000, or both     

Felony assault and battery against a household member can result in up to 5 years in prison, a fine of up to $2,000, or both.
